Mr Rolfe conducted a sobriety test on Mr Brooks in the car park

Rayshard Brooks shooting: US policeman faces murder charge

Garrett Rolfe, who has already been fired, faces 11 charges related to Rayshard Brooks' death. If convicted, he could face the death penalty.

The other officer at the scene, Devin Brosnan, will testify as a witness in the case, officials said.

The case comes amid US protests over police killings of black Americans.

Lawmakers in Washington are currently debating new police reform laws.

Officer Brosnan - who has already been placed on administrative leave - will be charged with assault for standing on Mr Brooks' shoulder as he lay dying.

Atlanta officer who fatally shot Rayshard Brooks charged with murder

Brooks, 27, was shot twice in the back at Wendy's drive-thru.

Prosecutors brought murder charges Wednesday against the white Atlanta police officer who shot Rayshard Brooks in the back, saying that the Black man posed no deadly threat and that the officer kicked him and offered no medical treatment for over two minutes as he lay dying on the ground.

Brooks was holding a stun gun he had snatched from officers but was running away and was more than five metres from Officer Garrett Rolfe when Rolfe opened fire, District Attorney Paul Howard said in announcing the charges five days after the killing outside a Wendy's restaurant rocked the city.

"I got him!" the district attorney quoted Rolfe as saying.

The felony murder charge against Rolfe carries life in prison or the death penalty, if prosecutors choose to seek it. He was also charged with 10 other offences punishable by decades behind bars.

"We've concluded at the time that Mr. Brooks was shot that he did not pose an immediate threat of death," Howard said.

75-year-old protester shoved to ground by Buffalo police has skull fracture: lawyer

The officers have pleaded not guilty.

A 75-year-old protester who struck his head on pavement after being shoved back by police remained hospitalized Tuesday with a fractured skull, his attorney said.

Martin Gugino's lawyer has told media outlets in recent days that he had not yet been able to walk. Attorney Kelly Zarcone said in an email Tuesday there was no change in his condition and that she expects only gradual improvement.

Two Buffalo police officers have been charged with second-degree assault after a widely shared video captured Gugino falling to the ground after being pushed on June 4. He was seen bleeding from his head as officers walked away.

The officers, who could face prison sentences of up to seven years if convicted, have pleaded not guilty.
